1. Housing Disrepair
Landlords have a duty to keep your home in good repair,
we can help you claim against your landlord where they
have failed to do so.
If you have problems with housing disrepair and your
landlord is failing to carry out the repairs despite
your requests, we can assist in the following ways:
- We can assist in bringing pressure on your landlord
to carry out repairs
- We can assist in bringing a claim for compensation
against your landlord for the previous failure to
carry out those repairs and for the distress and inconvenience
that you have suffered as a result
- We can advise on bringing proceedings under the
Environmental Protection Act if the conditions in
which you are living constitute a “statutory
nuisance”. A “statutory nuisance”
is where a property is deemed to be unfit for human
habitation.

2. Unlawful Evictions
We offer assistance in bringing claims against your
landlords if you have been evicted in circumstances
where you have not consented to vacating the property
and/or where the relevant notices and court orders have
not been obtained. Landlords have a duty to follow proper
legal procedures for regaining possession of a property.
You cannot be evicted from the property without the
court having granted the landlord permission to repossess
the property.
If your landlord fails to follow the correct legal
procedure, this may constitute an unlawful eviction
and you are able to bring a claim against your landlord
for compensation for aggravated and exemplary damages.

3. Possession Proceedings
We offer advice on possession proceedings in both landlord
and tenant and mortgage possession proceedings.

If you have received notification that your landlord
intends to bring possession proceedings against you,
we can assist in:
- Advising you on defending the claim for possession
- Advising you on the technicalities of the proceedings
- Advising you on rehousing if you do not have a good
defence to the possession claim.
- Negotiating with the landlord in order to find an
alternative solution.
Mortgage Possession Proceedings
We offer the following assistance to you:
- Defending a mortgage possession claim
- Advising on the technicalities of possession proceedings
- Negotiating with the landlord in order to find an
alternative to possession proceedings so that you
can continue (wherever possible) to live in your house.

4. Neighbour Nuisance Proceedings
We offer assistance in a wide range of different aspects
of neighbour nuisance law.
Defending Neighbour Nuisance Proceedings
Local Authorities and Housing Associations now have
wide ranging powers to bring a variety of proceedings
against tenants. We can assist in defending injunction
and possession proceedings brought on the grounds of
neighbour nuisance.
Problems with anti-social neighbours
If you have problems with anti-social neighbours, we
can assist in the following ways:
- advising on bringing an injunction under the Protection
from Harassment Act 1997
- Advising on other options open to you.

5. Rehousing
We furthermore offer advice on rehousing. Local authorities
have certain statutory duties to rehouse. We can advise
on decisions to refuse to rehouse you or to not award
you the correct priority points.
