- Antisocial behaviour
Housing associations find dealing with antisocial tenants
a stressful and time – consuming task. Nonetheless,
whilst not wising to be seen as ‘Big Brother’,
they recognise the need to tackle antisocial behaviour
as quickly as possible. In doing this, they have the
law on their side; there are measures that can be taken.
- Written Warning:
A firm letter of warning to an offending tenant of
the consequences of persistent antisocial behaviour,
including the likelihood of legal action, can be effective.
- Notice Seeking Possession:
This is the first formal step towards obtaining eviction;
it is a useful device for issuing a warning to an
antisocial tenant. It remains valid for 12 months.
- Injunction
This quick and simple device can often persuade tenants
who have breached the terms of their Tenancy Agreement
not to do so again.
- Power of Arrest
In case of violence, serious abuse, or racism, the
law also provides a ‘power of arrest’
as a powerful deterrent against repeat offending.
- Possession Proceedings
This is the most draconian process for managing antisocial
behaviour; it results in the removal of the perpetrator
from the property.
Guided by law, facts and evidence, Housing Associations
can use one or more of these measures to combat antisocial
behaviour.
